By accessing or using https://www.thepinkcirclefoundation.org/ (the “Website”) or any services, information, content, applications or materials provided by the Foundation through the Website (together, the “Services”), you agree to be bound by these Terms & Conditions (these “Terms”). If you do not agree to these Terms, do not access or use the Website or Services.

1. Definitions

 

1.1 “User”, “you”, or “your” means any person who accesses or uses the Website or Services.


1.2 “Donor” means a User who makes a monetary or in-kind contribution to the Foundation.


1.3 “Content” means all materials on the Website, including but not limited to text, graphics, logos, images, video, audio, data, reports, and software.

2. Eligibility

 

You represent and warrant that you are of legal age and capacity under applicable laws to form a binding contract. If you are a minor under applicable law, you may use the Website only with the involvement and consent of a parent or legal guardian.

3. Use of the Website; License

 

3.1 Subject to your compliance with these Terms, the Foundation grants you a non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use.


3.2 All intellectual property rights in the Website and Content (including, without limitation, copyrights, trademarks and database rights) are owned by or licensed to the Foundation, except where explicitly stated otherwise. No rights are granted to you other than as expressly set forth in these Terms.


3.3 You must not copy, reproduce, modify, publish, transmit, distribute, perform, display, create derivative works from, or otherwise exploit the Content for any commercial purpose without the Foundation’s prior written consent.

4. Account Registration and Security

 

4.1 Certain features of the Website may require registration. You agree to provide accurate, current and complete information during registration and to update such information to keep it accurate.


4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify the Foundation immediately of any unauthorized use.

5. Donations, Receipts, and Tax Treatment

 

5.1 Donations: Donations made through the Website are voluntary and are subject to these Terms and any additional donor terms displayed at the time of donation. Donations may be accepted in various forms (online payment, cheque, transfer or in-kind).

 

5.2 Receipts & 80G Certificates: The Foundation will endeavour to issue donation receipts and certificates for tax purposes in accordance with applicable laws and procedures. Eligibility for tax deduction under Section 80G and registration benefits under Section 12A of the Income Tax Act, 1961 depend on the donor meeting statutory requirements and the Foundation’s compliance. Receipt issuance may require the donor to provide complete and accurate KYC and contact details.


5.3 Tax Advice: Nothing on the Website or in any receipt constitutes tax advice. Donors should consult a qualified tax advisor for guidance on the tax treatment of donations.


5.4 Refunds: Donations are generally non-refundable. Refunds will be provided only in exceptional circumstances (e.g., payment processing error, duplicate payment) at the Foundation’s sole discretion and subject to any applicable laws. Where a refund is approved, the Foundation may deduct reasonable administrative/transaction charges.


5.5 Payment Processors: Payment transactions may be processed by third-party payment gateways. The Foundation does not control third-party processors and is not liable for their acts or omissions. All payment information is provided directly to the payment processor and is subject to the processor’s terms and privacy policy.

6. Volunteer Engagements and Program Participation

 

6.1 Volunteers or program participants may be required to enter separate agreements, background checks or verification prior to engagement. The Foundation may accept or reject volunteer applications in its sole discretion.


6.2 The Foundation reserves the right to terminate any volunteer, participant, or beneficiary relationship for misconduct, breach of policies, or for any other reason at the Foundation’s discretion.

7. User Content and Submissions

 

7.1 “User Content” means any content, materials or information that you post, upload, transmit or otherwise make available via the Website.

 

7.2 By submitting User Content you grant the Foundation a worldwide, irrevocable, transferable, royalty-free, sublicensable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute and display such User Content in any media or format for the purpose of operating and promoting the Foundation and its programs.


7.3 You represent and warrant that you own or have the necessary rights to submit the content and that submission does not infringe any third-party rights or violate any law. You shall not submit unlawful, obscene, defamatory, infringing or otherwise objectionable content.


7.4 The Foundation may, but is not obliged to, monitor, edit or remove User Content for any reason. The Foundation disclaims all liability arising from User Content.

8. Privacy and Data Protection

 

8.1 Collection and Use: The Foundation collects and processes personal data in accordance with its Privacy Policy. By using the Website, you consent to such collection and processing as described in the Privacy Policy.

 

8.2 Legal Compliance: The Foundation may disclose personal data to comply with applicable laws, legal processes, governmental requests, to enforce these Terms, or to protect the Foundation’s rights, property, or public safety.


8.3 Security: The Foundation uses reasonable administrative and technical safeguards to protect personal data; however, no internet transmission is completely secure and the Foundation cannot guarantee absolute security.

a) Use the Website for any unlawful purpose or in violation of applicable laws and regulations;

12.1 No Warranties: The Website and all Content are provided “as is” and “as available” without warranty of any kind, whether express, implied or statutory, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, title, non-infringement or arising from a course of dealing or usage of trade.


12.2 Information Accuracy: While the Foundation strives to ensure information on the Website is accurate, it makes no representations or warranties as to the accuracy, reliability, completeness, or timeliness of the Content.


12.3 No Professional Advice: Content on the Website is for informational purposes only and does not constitute legal, tax, medical, or other professional advice.

13. Limitation of Liability

 

To the maximum extent permitted by applicable law, in no event will the Foundation, its trustees, officers, employees, agents, volunteers, or representatives be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, goodwill, use, data or other intangible losses arising from or relating to your access to, use of, inability to use, or reliance on the Website or Services, even if advised of the possibility of such damages.

14. Indemnity

 

You agree to indemnify, defend and hold harmless the Foundation and its trustees, officers, employees, volunteers, agents and affiliates from and against any losses, liabilities, claims, demands, damages, costs and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your breach of these Terms; (b) your violation of applicable law; (c) your User Content; or (d) your use of the Website.

15. Force Majeure

 

The Foundation will not be liable for any failure or delay in performing its obligations under these Terms (other than payment obligations) caused by events beyond its reasonable control, including but not limited to acts of God, strikes, lockouts, labour disputes, pandemics, epidemics, acts of government, electrical, internet or telecommunication failures or outages.

16. Modification of Services and Terms

 

16.1 The Foundation reserves the right to modify, suspend or discontinue the Website or Services (or any part thereof) at any time without prior notice.


16.2 The Foundation also reserves the right to change, add or remove provisions of these Terms at any time. Changes will be effective when posted on the Website with an updated “Last updated” date. Your continued access to or use of the Website after such changes constitutes acceptance of the updated Terms.

17. Termination

 

The Foundation may, in its sole discretion and at any time, suspend or terminate your access to the Website and Services with or without notice for any reason, including violation of these Terms. Upon termination, the licenses and rights granted to you will immediately cease.

18. Governing Law, Dispute Resolution and Jurisdiction

 

18.1 Governing Law: These Terms are governed by and shall be construed in accordance with the laws of India.


18.2 Dispute Resolution: Any dispute, controversy or claim arising out of or relating to these Terms or the Website shall, to the extent possible, be resolved amicably through good-faith negotiations between the parties. If such negotiations fail, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by mutual agreement; failing which the arbitrator shall be appointed in accordance with the said Act. The seat of arbitration shall be Hyderabad/Secunderabad, Telangana, India and the language of the arbitration shall be English.


18.3 Courts: Notwithstanding the above, the Foundation may seek injunctive or other equitable relief in any competent court to protect its intellectual property rights or confidential information. Subject to arbitration where applicable, courts located in Hyderabad/Secunderabad, Telangana shall have exclusive jurisdiction over any disputes not covered by arbitration.

19. Severability

 

If any provision of these Terms is found by a competent court or tribunal to be invalid, illegal or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.

20. Waiver

 

No waiver by the Foundation of any right or remedy under these Terms shall be effective unless in writing and signed by an authorized representative of the Foundation. The failure or delay by the Foundation to exercise any right will not operate as a waiver of that right.

21. Entire Agreement

 

These Terms, together with the Privacy Policy and any other legal notices published on the Website, constitute the entire agreement between you and the Foundation with respect to the Website and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written.

22. Electronic Communications

 

By using the Website or providing contact or donor details, you consent to receive electronic communications from the Foundation (including email, SMS or other electronic messages). Such communications may include notices about your account, transactional messages, updates about programs, fundraising appeals, or legal notices.
